Abstract
بظهور وباء ًكورونا (ًكوفيد 19) وإتساعه وتهديده للصحة العامة تم إتخاذ العديد مًن القرارات لإحتوائه والحد من إنتشاره، قد يترتب عليها المساس بالحياة الخاصة وخصوصية الأشخاص، إذا لم يتم الموازنة من جهة بين حساسية البيانات ذات الطابع الشخصي بشكل عام والبيانات الطبية بشكل خاص وبين إجراءات مكافحة الفيروس (ًكوفيد 19)من جهة ثانية، وبناء على ذلك تهدف الدراسة إلى تحديد طبيعة الحماية المقررة للمعطيات ذات الطابع الشخصي وفقا للقانون 18/07 خاصة في ظل حالة الطوارئ الصحية، وقد تم التوصل إلى نتيجة مفادها أن الحق في الصحة مرتبط بإحترام الخصوصية والمشروعية في الوصول إلى المعلومات ومعالجتها، ولا يكون ذلك إلا بإقرار نصوص قانونية تتناسب مع حالة الضرورة من جهة، وتحترم فيها الخصوصية من جهة أخرى.
With the emergence of the Corona epidemic (Covid 19), its expansion and its threat to public health, many decisions have been taken to contain it and limit its spread, which may result in an infringement on the private life and privacy of people, if the sensitivity of personal data in general and medical data in particular is not balanced on the one hand, and procedures Combating the virus (Covid 19) on the other hand, and accordingly this study aims to determine the nature of the protection prescribed for data of a personal nature in accordance with Law 18/07, especially in light of a state of health emergency, and a conclusion has been reached that the right to health is linked to respect for privacy. And legality in accessing and processing information, and that can only be done by approving legal texts that are commensurate with the case of necessity on the one hand, and where privacy is respected on the other hand
