Summary :
This dissertation delves into the intricate topic of establishing proof of divorce within the framework of Algerian family law. To ensure stability in legalstatuses post-divorce, Algerian legislation mandates the formalization of divorce through a court-issued decree. However, this requirement has given rise to numerous legal and religious complexities, prompting the need for solutions that align with Islamic principles. Through sound legal and Sharia interpretation, this dissertation addresses both substantive and procedural aspects of divorce proceedings.By analyzing the relevant provisions of the Algerian Family Law and its procedural regulations, the dissertation examines the legal framework and various rulings pertaining to the study topic. It also explores case law from Algerian courts and Supreme Court decisions to shed light on the judiciary\'s stance amidst the apparent legislative ambiguity in relation to Islamic Sharia principles.
