Abstract:
Foreign investments are associated with non-commercial risks, whether they are beyond the will of the host country to invest, such as political risks, including wars, civil unrest and others. Unilateral or indirect measures\", or their incidence resulting from the will of the host State, Given the importance of foreign investment and the economic development of countries These risks have become obstacles to foreign investments\' success and expansion.
The need to provide a protective legal regime for the latter has arisen, namely, the establishment of a legal framework governing the protection of Algerian law, both substantive and related to the treatment of foreign investments and the protection of their funds, and a procedural part of the settlement of disputes arising from foreign investments.
Moreover, given the growing interest in the issue of foreign investment, international law has established a set of international legal norms that provide legal safeguards to protect foreign investments from various non-commercial risks, It is essentially both customary international and other rules of the Convention. and regulated the resolution of existing conflicts through the development of means to do so, with a view to establishing the internationalsecurity system as amodern means of addressingnon-commercial risks, Furthermore, specialized international investment guarantee bodies, whether regional or international, have been established in order to give effect to legal protection in this regard.
